Right of withdrawal for consumers

Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving reason.
The period for withdrawal is 14 days counting from the day,
- when you or a third person (not the carrier) named by you takes possession of the ordered item(s); provided you have ordered one or more items within one standard order and this item or these items are being delivered standardised either;
- when you or a third person (not the carrier) named by you has taken into possession the last item(s), provided you have ordered more items within one standardised order and those are being delivered separately.
In order to exercise your right of withdrawal you are obliged to clearly inform us in writing (i.e. via mail, fax or e-mail) about your decision to withdraw from this contract to the following address: Kugelmann Maschinenbau e.K., Gewerbepark 1-5, D-87675 Rettenbach a.A., phone number: +49 (0)8860/91 90-0, e-mail-address: office@kugelmann.com. You can use the attached standard withdrawal form, which is however not prescribed.
In order to comply with the withdrawal period you merely need to act within the expiration period of your right of withdrawal.
Consequences of the withdrawal
When you withdraw from this contract we will have to refund to you all payments immediately without delay or at the latest within a period of 14 days counting from the day we received your withdrawal from this contract, including cost for shipment (not included, however, is the extra cost which might be induced by asking for special delivery differing from our standardised delivery process). For any refund we use the same instrument of payment that you used for the original payment, unless we have explicitly agreed upon something else; never, however, we will charge you for this refund.
We can deny the refund until we got the item(s) back from you or until we received a proof that you returned the item(s) via mail or carrier, depending on what we can get faster.
You will have to return the item(s) immediately without delay – at the latest within a period of 14 days counting from the day you informed us of your withdrawal from this contract, or to bring them back physically, respectively. You adhere to the expiration period as long as the item(s) in question are being returned within that period of 14 days.
You have to bear the direct costs of the return shipment for those item(s).
You have to compensate for a possible decrease in the value of the item(s) in question due to a necessary checking of the condition, characteristics and functioning. You shall only be liable for any decrease in the value of the goods resulting from the handling other than what is necessary to ascertain the nature, characteristics and functioning of the goods.
Preclusion or reasons for expiry
The right of withdrawal does not exist with contracts for
- any delivery of item(s) that are not prefabricated and that need for their production individual selection and specification by the customer or that are produced according to the specific needs of customers;
- any delivery of item(s) that can vitiate or that have a close date of expiry;
- any delivery of item(s) that comprise alcoholic drinks with a contractually agreed price and that can only be delivered 30 days after signing the contract and that are apt to a volatile market value that cannot be influenced by the contractor;
- any delivery of newspapers, periodicals and magazines except subscriptions.
The right of withdrawal expires before maturity in case of contracts
- concerning delivery of sealed items that due to sanity or hygienic reasons cannot be returned once they were unpacked;
- concerning delivery of items that due to their condition were being mixed irrevocably with other goods;
- concerning delivery of audio and video recordings or computer software in sealed packages once unpacked.
